Sadly I'm going to have to completely shut down my entire gallery as people keep stealing my art and making NFTs. I can't - and shouldn't have to - report each one and make a case, which is consistently ignored. Sad and frustrating.

You can choose to have a digital ID. If you do, all of your art that is not signed with your digital ID will be considered fake/stolen by default. And you oppose this for some reason? And also complain about the tech that allows this in the digital era. Don’t become obsolete.

That will help persuade people to realize the flaws in the NFT hype and ultimately the NFTs of the work will be worthless.

OpenSea just stopped honouring regular takedown requests / messages / emails. Now they only accept legal documents with legally binding "artist gets prosecuted if they lied to OpenSea" clause (DMCA)

Before you say that artists should use NFTs, just remember that people can screenshot/right click + save them. NFTs are pretty much useless at protecting artists. They're like hidden watermarks that no one care about. We don't have to needlessly pollute the environment for this

Fake NFTs are worthless, and if you get a sucker to buy one then lucky you, but it would quickly run dead.
Buyers aren't stupid.
Only authentic NFTs with verifyable ownership & creation history will build value, and can be programmed.

Another thing to keep in mind is anybody can create an NFT for anything an unlimited number of times.
Even the author can create multiple NFTs for one piece.
The key is all fakes are just that - worthless fakes that will never build value.

Because deviant art literally can’t do that. The true owner of the stolen art has to be the one to deal with it. Even if DA tried NFT websites would not take being notified seriously. There are artists with hundreds of there pieces stolen.

Protect might be ironically harmful to artists. NFTs, the way they have been done, are unfortunately causing more harm than good to talented artists, and Protect is enabling this trend to continues. NFTs are a cool in concept, but very poorly executed.

Technically no because the NFT itself isn't the image. It's a bunch of number on a block chain that reference an image, usually by URL. So there is nothing stopping anyone from having the same image at a different URL as a separate NFT.

OpenSea appears to be using Google as their hosting provider for images. If you send a fully compliant DMCA takedown notice to Google, then Google are legally bound to at least respond to and act upon your notification.

Usually platforms respond to a DMCA takedown notice very quickly, but opensea is notorious for either making the process as hard as possible, or just flat out ignoring you. Usually if the DMCA is ignored, which is illegal by the way, you have to take legal action

Can you claim the money after they sell, so you can just pick your battles better?
Perhaps you can also see if you can obtain big bucks from Opensea or the sellers via copyright infringement lawsuits.
Does Opensea's role in displaying & minting the NFTs create liability for them, so they are not protected under the DMCA?

Where can I read about DeviantArt having chosen to become an NFT marketplace? All I see is that they use image recognition to alert users of plagiarism, including stolen art used offsite by NFT fraudsters. I.e., they actively help combat NFT fraud. What did I miss here?

It's no hard to put something for sale on opensea, it's literally a few clicks. I'll support any artist that wants to go in, it's just that I assume anyone capable of posting on DeviantArt, capable of posting on opensea by themselves. Here for help if needed

Are you shutting down only your DeviantArt or other art accounts and your website too?
Because if not, I'd advise you to keep DeviantArt, it's the only place that informs you when someone is stealing your artwork
If this is possible try to take advantage of that. Two things in my mind: 1. They make your art more popular for free (which is good unless you are already a recognizable rock start worldwide) 2. Legal case to court and make the thieves (or NFT network owner) pay.
Perhaps, DA should make NFTs, that way you have it on the Blockchain prior to anyone else trying to steal it?

The fact that can scan for NFTs made with their images leads me to believe that should be able to set up a system that preemptively checks sites when an NFT is minted to ensure the seller isn’t minting using stolen material. They won’t, but they should.

What this tells me is that we need a better way to verify authenticity with NFTs, and that marketplaces should be doing more in the name of copyright

While nothing is lost indeed, most people would be pissed off if someone else made a profit on something they made. Also these NFTs websites also steal arts without covering/removing the watermark like how lazy and evil they are?

Tbh deviantart owns all of your shit anyways and can use it for merch elsewhere if they wanted so that was probably never a good idea to be on there in the first place.
I recently had my photos stolen on Opensea as well from DeviantArt
